STATEMENT

GENERAL DATA PROTECTION REGULATION 2016/679

Introduction

The purpose of this statement is to provide more information about the processing of information of the users who use the services accessible from the websites netstrategy.it and forbit.it. This processing is made by Forbit s.r.l. and/or other identified people for the purposes indicated below. In particular, the statement is provided pursuant to Legislative Decree 30 June 2003 no. 196 and of the EU Regulation n. 679/2016 (respectively "Privacy Code", "GDPR" and jointly "Applicable Regulations") and exclusively concerns the aforementioned sites: therefore it does not concern any other websites reachable by the user through links present on the same.

We inform you that we process with attention your personal data, implementing safety standards compared to the high level of measures already used.

The statement will be continually updated and it will based on the future technologies changes, purposes and/or guidelines of the European Guarantors and the European Committee and the date of last update will always be published.

 

1. Who process your personal data?

The owner of each personal data processing operated by our company is FORBIT SRL, a sole shareholder, legally represented by Robbi Stefano, P.IVA 04197660238, with legal and operational headquarter in CEREA (VR), Via Lorgna n.37, reachable by email at privacy@netstrategy.it

In order to guarantee you the best safety in the processing data, we have also appointed a professional figure outside the company, as suggested by the regulation of EU: the Data Protection Officer otherwise named Data Protection Officer - DPO in the person of the Lawyer Robbi Silvia, whose office is in Verona, Via G.B. da Monte, n. 8. You can contact her by e-mail at robbi@ctsa.it or by postal service at the registered office of our company, placing the communication recommended to the attention of Avv. Silvia Robbi.

Your data will be handled by personnel within the company specially appointed “Data processor”. Personnel is periodically trained and updated about its roles, responsibilities, duties and methods of processing data and always does its activities under the direct control of the owner of processing data.

 

2. Categories of subjects to whom the data may be communicated or become aware of them

Without prejudice to communications made in fulfillment of a legal, regulation or current legislation, communication, even by simply consulting or making available the data concerning you, can be used in relation to the following categories of persons: physical persons or legal entities that provide specific services to our legal, administrative, tax and/or accounting consultancy, credit recovery, repair, installation, replacement or updating of electronic/IT equipment.

The persons indicated above will be appointed as data controllers and must comply with the same high data protection conditions as applied by our company and the same privacy regulations contained in this statement.

We assure you that, in any case, will be transferred/communicated only the data relevant to the purposes of the processing to which the individual persons in charge and data controllers are responsible. These subjects must respect the same conditions of confidentiality and data protection indicated in this statement.

Outside of the cases indicated above, your personal data will not be diffused and communicated to third parts, except through your estimate and explicit consent.

 

3. Source of personal data

All collected data are processed in compliance with the current legislation and with due confidentiality.

The data in our possession, obtained by contractual or precontractual relationships, have been collected directly from the data subject both in paper and digital form.

The data processing takes place in manual and automated, paper and digital form.

Data may be collected sometimes even from third parts, but just only upon your free and informed consent issued to the owner of data processing.

 

4. Data communication refusal

The request for personal data present in the forms on-line on the website www.netstrategy.it, necessary for the request of information and/or download services and/or creating a commercial relationship, is optional, but the refusal of this kind of communication determines the impossibility for the company to accept your precontractual/contractual request. The communication of personal data is therefore a necessary requirement for the conclusion of the contract for download services and/or request of information about all the services offered by our company.

Data collection through the contract (in paper or digital form) for the supply of goods and/or services is a contractual obligation and necessary to fulfil legal (for example in tax and accounting matter).

The refusal of communication of data by the subject as requested in the contract for the supply of good and/or services make the conclusion of contract impossible.

Data collection for promotional purposes is optional and the refusal does not affect the provision of the requested service.

Data collection takes place, as well as through online forms, also through technical, analytical and third-party profiling cookies; profiling cookies are for the sole purpose of knowing your browsing on the site and data collection is optional. The refusal of the installation of profiling cookies does not prevent the use of the services of the site, however it can cause difficulties and delays in navigation, the appearance of generic advertisements, the incomplete exploitation of the site potential as well as other temporary difficulties or slowdowns use of the site.

 

5. Purposes and legal basis of the processing

Data processing and collection is adequately provided for the performance of the economic activity of our company and in particular for:

  1. Exchange of pre-contractual information also for the supply of download services;
  2. Administrative-tax and accounting management;
  3. Contractual execution;
  4. Store of personal data for three years from the last expression of interest through the interaction of our company netstrategy.it, while for the tax-relevant documents the conservation is linked to the current legislation; at the end of the period indicated below data will be definitely deleted;
  5. Sending promotional communication using also automated methods;
  6. Reports through the use of cookies to capture use behaviour (for example, the identification of clicks) made on the websites netstrategy.it and forbit.it, without any automated decisions can be taken that can determine legally significant consequences for data subject; information will be used to realize if the topics covered on the website have been appreciated by the user. We are implementing company resources to make not identifiable the activities on the website, with particular regard to the use of analytical cookies (compatibly with the technological evolution and costs necessary for this activity).

For the processing of the data referred to the previous letter e) and f) the legal basis of the processing is the express consent of an optional nature.

Personal data processing based on a contract in which the subject takes part, letters a), b), c) and d) of this article, and/or about a legal obligation, does not require the express consent of the subject.

 

6. Methods of processing, storage and destruction of personal data

The data will be processed in a lawful and correct manner and in any case in compliance with the aforementioned law, by instruments that guarantee security and confidentiality and may also be performed using automated, manual or software tools and/or digital technologies designed to store and manage data.

The processing will be carried out, primarily, by internal organization of the company through its employees under the direction and the control of Data Controller.

Data collection will take place in a form that allows the identification of the data subject for a period of time not exceeding than the necessary for the purposes they are stored and processed. Successively they will be deleted.

In consideration of the particular nature of its role, the company undertakes and commits its collaborators to keep confidential and to not communicate, make known or diffuse to third parts information or news it has known during the commercial relationship.

Personal data will be managed in such a way that guarantees an adequate safety, including the protection, through technical and organizational measures, for example the possible application of encryption, in order to prevent unauthorized or unlawful processing, loss, theft, accidental or malicious destruction or due to accidental damage, within the limits of diligence and the sector in question.

It is specified that no particular data and/or judicial data and related to criminal offenses are processed.

Personal data may be stored in the terms indicated above in such a way as to allow them to be transferred to archives of other EU Member States or to third countries, whose companies are certified and comply with the EU-USA Privacy Shield regulations and ensure an adequate level of protection and security and keep them encrypted on secure storage servers located in data centres in the United States.

 

7. Right of Access

Pursuant to article 13 of the GDPR 679/2016, the interested party may contact our company, at the following e-mail address: privacy@netstrategy.it and will be found within three working days, to assert the following rights:

Access / communication of personal data concerning you;

Obtain the updating, correction, deletion and / or limitation of the processing of personal data;

To obtain the portability of personal data on a structured digital support, so as to be easily transferred to another data controller;

Oppose, in whole or in part to the processing of personal data; opposition to automated treatments includes opposition to manual treatments.

8. How could you oppose to the treatment?

The interested party has the right to object at any time for reasons related to his/her particular situation to the processing of his/her personal data pursuant to Article 6) paragraph 1, letter e) or f) including profiling on the basis of these provisions.

If personal data are processed for direct marketing purposes, the data subject has the right to object at any time to the processing of personal data concerning him/her for such purposes including profiling in so far as it is related to such direct marketing.

The opposition does not undermine the legitimacy of the treatment in accordance with the legislation in force before the opposition.

 

9. What if you are a child under the age of 16?

The type of services offered by the website netstrategy.it are not intended for persons under the age of sixteen; therefore, in this case we suggest you come back and visit us at the age of 16.

If investigations carried out by our company directly or upon notification, it should be found that the user is less than 16 (sixteen) we will immediately delete their personal data, report to the competent authority and we will take judicial / administrative initiatives.
